1. Definitions

1.1 You/Your means the person contacting IntegrityTeks and/or anyone who authorizes access to the computer system to be serviced.

1.2 We/Us means IntegrityTeks.

1.3 Hardware means any physical equipment directly involved in the performance of data-processing or communications functions.

1.4 Software means the programs, routines, and symbolic languages that control the functioning of the hardware and direct its operation whether owned by customer or licensed directly to customer from a third party.

1.5 Peripheral means any device with an external connection to the computer system such as printers, monitors and scanners.

1.6 Product means any hardware or software.

2. Services

2.1 Your Responsibility: YOU ACKNOWLEDGE THAT SOFTWARE, OPERATING SYSTEMS AND DATA MAY CHANGE OR BECOME CORRUPTED DURING NORMAL USE, THROUGH UPDATES, MALWARE, HARDWARE FAILURE OR USER ACTIONS, AND AGREE THAT IntegrityTeks SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR CORRUPTION OF DATA OR FOR SOFTWARE ISSUES ARISING AFTER YOUR DEVICE HAS BEEN RETURNED.

2.2 Limitations of Service: We reserve the right to decline or discontinue service at any time and issue a partial or full refund. We shall not be responsible for any loss arising from refusal or inability to complete service.

2.3 Authority: You must provide authorized contact person(s) for service approvals. An authorized individual must be present for on-site work. If not available, service may be declined and a displacement fee may apply.

2.4 Access: We must be provided safe and reasonable access to equipment, workspace, and electrical power. Failure to provide access may result in service refusal and/or additional charges.

2.5 Assumptions: We assume all software and accounts are legally licensed unless otherwise disclosed in writing. Devices are assumed to have pre-existing conditions (working or non-working) unless explicitly documented at intake. IntegrityTeks does not certify or guarantee prior operational status unless expressly confirmed in writing.

3. Warranties and Return Policy

3.1 Hardware Repair Warranty: Most hardware repair labour is covered by our thirty (30) day limited workmanship warranty commencing on the date the repaired device is returned to you. This warranty applies only to the original repair performed and covers defects resulting directly from our workmanship. It does not cover unrelated hardware or software failures.

3.2 Replacement Parts: Replacement parts supplied by IntegrityTeks are covered solely by the manufacturer's warranty, if any. If a replacement part fails within our thirty (30) day workmanship warranty period but the manufacturer's warranty has expired or provides no coverage, our labour warranty remains in effect; however, the replacement part itself is not covered and replacement part costs will apply. If a replacement part fails after our workmanship warranty has expired but remains under the manufacturer's warranty, we will make reasonable efforts to assist you in obtaining a warranty replacement. Labour charges for diagnosis, removal, installation, testing, shipping, handling or related services will apply. Reduced labour rates may be offered at our discretion.

3.3 Software Repairs: Software repairs, including operating system repairs, malware removal, software installation, software configuration, driver installation, updates and application troubleshooting, are tested prior to your device leaving our premises. Because software, operating systems, updates, user actions, third-party software, malware and hardware changes are beyond our control after service is completed, software-related repairs are not covered once your device has left our premises or has been returned to you.

3.4 Operating System, Software and Data: Our warranty does not extend to your operating system, software, applications, software licensing, updates, user settings, device drivers or your data. IntegrityTeks is not responsible for data loss, data corruption, malware, viruses, ransomware or changes made by you or any third party after your device has been returned. You are solely responsible for maintaining current backups of your data prior to service.

3.5 Warranty Exclusions: Warranty coverage does not apply to damage or failures resulting from misuse, abuse, accidents, physical damage, liquid damage, electrical issues, power surges, environmental conditions, normal wear and tear, unauthorized repairs or modifications, customer-supplied parts, or problems unrelated to the original repair.

3.6 Loss of Warranty: Any repair, modification, tampering, installation or servicing performed by anyone other than IntegrityTeks after completion of our work may void applicable warranty coverage relating to the affected repair.

3.7 Third Party Software: You are responsible for compliance with all software licensing requirements. You confirm you have the legal right to use any software requested for installation and agree to indemnify IntegrityTeks against any third-party claims arising from its installation or use.

3.8 Manufacturer Warranty Notice: Certain repair procedures may void manufacturer warranties. IntegrityTeks accepts no responsibility for any resulting loss of manufacturer warranty coverage.

3.9 Warranty Claims: All warranty claims are subject to inspection by IntegrityTeks to determine whether the reported issue relates to the original repair. If the issue is found to be unrelated or excluded under these Terms, standard diagnostic and labour charges may apply.

4. Liability

4.1 Release of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ONTARIO LAW, IntegrityTeks SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR DEVICE FUNCTION ARISING FROM SERVICES PROVIDED.

4.2 Limitation of Remedy: Your sole remedy for any claim shall be limited to the amount paid for services rendered, where legally applicable.

4.3 Pre-Existing Conditions: IntegrityTeks is not responsible for pre-existing faults, latent defects, or hardware failures that may exist before, during, or after service.

4.4 No Guarantee of Repair: While reasonable care is taken, IntegrityTeks does not guarantee that any service, repair, or diagnostic work will resolve the reported issue or restore full functionality.

4.5 Customer-Supplied Parts:

When customer-supplied parts are provided, IntegrityTeks performs installation services only and makes no warranty or guarantee regarding the quality, compatibility, authenticity, functionality, or reliability of such parts. The customer assumes all risks associated with customer-supplied components.

IntegrityTeks is not responsible for defects, failures, incompatibility issues, or damage caused by customer-supplied parts, whether existing before, discovered during, or after installation.

Unless otherwise agreed in writing, IntegrityTeks does not perform full diagnostic verification of the device or customer-supplied parts beyond what is required to complete the requested service.

Additional labour charges may apply for diagnostics, troubleshooting, or corrective work arising from defective or incompatible parts.

4.6 Severability: If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect.

5. Prices and Payments

5.1 Prices: All prices are subject to applicable taxes.

5.2 Payment: Payment is due upon completion unless otherwise agreed. Hardware or software may require prepayment.

5.3 Late Fees: Overdue accounts may be charged interest at a rate of 20% per annum (1.67% per month) after 30 days.

5.4 Storage and Abandoned Equipment: Repaired equipment must be picked up promptly upon notification that service has been completed. IntegrityTeks reserves the right to charge reasonable storage fees for any equipment not collected within thirty (30) days after notification of completion, unless otherwise agreed in writing. Equipment remaining unclaimed for ninety (90) days after notification, despite reasonable attempts to contact you using the contact information you provided, may be deemed abandoned. To the fullest extent permitted by applicable law, IntegrityTeks reserves the right to dispose of, recycle, sell or otherwise deal with abandoned equipment in order to recover outstanding amounts owing, storage fees and costs of disposal. Any remaining proceeds, if applicable, will be handled in accordance with applicable law. IntegrityTeks shall not be liable for any loss of data or damage resulting from the disposal, recycling or sale of abandoned equipment carried out in accordance with these Terms.

6. Legal Notices

This website and business operate in Ontario, Canada. Any disputes shall be governed by the laws of Ontario.
